Welcome to Vobbin These Terms of Service ("Terms") govern your access to and use of the Vobbin mobile application, the Vobbin website at vobbin.com (the "Site"), and all related services and features (collectively, the "Services"). The Services are operated by Constend, the company behind Vobbin ("we", "us", or "our"). Please read these Terms carefully before using Vobbin. By creating an account or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services. We may update these Terms from time to time. When we do, we will update the date at the top of this page and notify you via the app or email for material changes. Continued use of the Services after changes take effect means you accept the updated Terms. 1. What Vobbin Does Vobbin is a personal health intelligence app. It connects to Apple HealthKit and accepts manual logs to generate health scores, recovery insights, and daily guidance. It also includes an AI-powered chat feature, community features, and habit tracking tools. Vobbin is designed for general fitness and wellness purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Nothing in the Services should be used as a substitute for the advice of a qualified healthcare professional. If you have a health concern, please consult a doctor. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY. 2. AI-Generated Content Some features of Vobbin use artificial intelligence to generate scores, insights, recommendations, and responses ("AI-Generated Content"). By using these features, you acknowledge that: • AI-Generated Content is generated automatically and may contain errors or inaccuracies. • AI-Generated Content is not medical advice and should not be treated as such. • You assume all responsibility for decisions you make based on AI-Generated Content. • We do not guarantee the accuracy, completeness, or suitability of any AI-Generated Content. You can control which health data categories are shared with the AI from within the app settings at any time. 3. Eligibility and Accounts To use Vobbin, you must be at least 13 years of age. Certain features, including subscriptions, sensitive health metrics such as reproductive health data, and any other features we designate from time to time, are available only to users who are 18 years of age or older ("Age-Restricted Features"). When you create an account, you agree to: • Provide accurate and truthful information • Keep your login credentials confidential • Notify us immediately at hello@vobbin.com if you suspect your account has been compromised • Not create more than one account • Not use the Services if you have previously been removed by us We reserve the right to suspend or terminate accounts that violate these Terms or misrepresent eligibility, including age. 4. Vobbin Free and Vobbin Plus Vobbin offers two tiers: • Vobbin Free: available to all users at no cost, providing core health tracking and basic insights. • Vobbin Plus: a paid subscription that unlocks deeper intelligence, AI chat in data-aware mode, advanced insights, and other premium features. Vobbin Plus subscriptions are purchased through the Apple App Store or Google Play. Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. We do not process or store your payment information — all billing is handled by Apple or Google under their respective policies. To cancel your subscription, go to your device's subscription settings through Apple or Google. Deleting the Vobbin app does not cancel your subscription. If you have a billing dispute, contact us at hello@vobbin.com within 30 days of the charge. We will do our best to resolve it promptly. We reserve the right to change the features included in each tier and to adjust pricing. We will give you reasonable notice before any price change affecting your active subscription. 5. Referral and Rewards Program Vobbin may offer a referral program that lets you invite others and earn rewards such as free months of Vobbin Plus or other in-app benefits. Participation is subject to the following: • Referrals are only valid when the referred person is a new Vobbin user who completes registration. • Rewards have no cash value and cannot be transferred, sold, or exchanged for cash. • You may only send referral invitations to people who have consented to receive them. • Abuse of the program, including creating fake accounts, using bots, or acting in bad faith, will result in disqualification and may result in account suspension. • We reserve the right to modify, suspend, or terminate the referral program at any time. Unredeemed rewards may be forfeited if the program ends. You are solely responsible for any tax obligations arising from rewards you receive. 6. Community Features Vobbin includes community features that allow users to follow each other, share health cards, and interact. When using community features, you agree not to: • Post content that is false, misleading, harmful, threatening, abusive, or harassing • Impersonate another person or entity • Share another person's private or personal information without their consent • Post content that infringes intellectual property or privacy rights • Use the community features to spam or promote products or services without authorisation • Advocate hatred or discrimination against any person or group We reserve the right to remove content that violates these guidelines and to suspend or terminate accounts responsible for such content. We do not screen all user interactions but reserve the right to do so. You are solely responsible for your interactions with other users. Vobbin does not verify the identity of users or conduct background checks. 7. Your Content and Data When you use Vobbin, you provide content including health logs, workout entries, profile information, and community posts ("Your Content"). You retain ownership of Your Content. By using Vobbin, you grant us a limited, non-exclusive licence to store, process, and display Your Content solely for the purpose of providing the Services to you. We do not use your health data for advertising, marketing, or any purpose beyond operating the app and its features. We may use anonymised and aggregated data — data that cannot identify you — to understand how Vobbin is used and to improve the product. When you delete your account, your personal data and health information will be deleted from our systems. Anonymised aggregate data may be retained. You can delete your account at any time from within the app settings. 8. Acceptable Use You agree to use Vobbin only for lawful purposes and in accordance with these Terms. You must not: • Attempt to reverse engineer, decompile, or extract the source code of the app • Probe, scan, or test the vulnerability of any part of our systems • Attempt to gain unauthorised access to any account, server, or network • Use automated tools or bots to access or scrape the Services • Distribute, resell, or sublicense the Services without our written permission • Use the Services for any fraudulent, harmful, or illegal activity • Interfere with or disrupt the integrity or performance of the Services 9. Intellectual Property Vobbin and all its content, features, design, logos, and technology are owned by Constend and protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited licence to use the Services as described here. If you send us feedback, suggestions, or ideas about the Services, we may use them freely without any obligation to you. We appreciate the input. 10. Third-Party Services Vobbin integrates with third-party services including Apple HealthKit, Google Fit, and AI providers. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the practices or content of third-party services. The Site and app may contain links to external websites. We do not endorse or take responsibility for the content of those sites. 11. Disclaimers THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. We are not responsible for any health outcomes resulting from decisions you make based on information or guidance provided through Vobbin. Always consult a qualified healthcare professional before making changes to your health routine. 12. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONSTEND AND ITS TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM, OR INR 1,000 / USD 12, WHICHEVER IS GREATER. 13. Indemnification You agree to indemnify and hold harmless Constend and its team from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (i) your use of the Services; (ii) your violation of these Terms; (iii) your Content; or (iv) your violation of any third-party rights. 14. Termination You may stop using Vobbin at any time and delete your account from within the app. We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or if required by law. Upon termination, your right to use the Services ends immediately. Your data will be deleted in accordance with our Privacy Policy. 15. Governing Law These Terms are currently governed by applicable laws without a specific jurisdiction designated. We are in the process of incorporating and will update this section with a specific governing jurisdiction once that is finalised. Until then, any disputes will be resolved in good faith between the parties. We will always attempt to resolve disputes informally first. General If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right. You may not assign your rights under these Terms to anyone else. We may assign ours in connection with a merger, acquisition, or sale of the company. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Constend regarding your use of Vobbin. 17.
